Legal Notices Limitation of liability
Claims arising from the impossibility of performance, positive infringement of a claim, fault upon conclusion of an agreement and illegal acting shall be excluded, unless there is evidence of willful intent or gross negligence on the part of XnX GmbH, its representative or vicarious agents. In this case, we especially shall not be liable for direct damage or subsequent damage, in particular damage resulting from the deletion or destruction of data, since it lies within the responsibility of the user to adequately protect and safe data. We are in any case not liable for contents of third parties, to which access is merely provided by us. In compliance with § 5 para. 3 of the German Telecommunications Service Act (TDG) an automatic and short-term display of contents of third parties via our servers is regarded as the provision of access. We shall be responsible for the contents of third parties constantly provided by us for use and even if they are illegal only in cases in which we have knowledge of the contents and in which it is technically feasible and acceptable to us to prevent its use. We are not obliged to regularly check such contents of third parties with respect to possible illegality.
